Kim Wehle illustrates through the various guardrails of democracy
established by the U.S. Constitution and the system of laws why and how the
criminal justice system is the sole remaining tool for deterring future crimes in
the Oval Office. However, for numerous reasons—including trial delays, the
absence of constitutional limits on presidential candidates, the obstinate
loyalty of the MAGA GOP, and the threat of a pardon (which is the subject of
her next book, out in June 2024), the fate of American democracy in all
likelihood remains at the behest of the political process. A successful
resolution at this crucial point in history is reliant upon having a functional
understanding of the legal and political frameworks that gave rise to the crisis.
She teaches and writes in the areas of administrative law, federal courts and civil
procedure with a particular interest in separation of powers questions, as well as in
the constitutional implications of structural and technological innovations in modern
government.
